The 1st Amendment only prevents Congress from making laws against freedom of speech, press, assembly, religion, and free exercise of such freedoms. That said, hate speech is protected because it is too broad and can be misconstrued to censor views one disagrees with from one that provokes violence, threatens one's life, and puts such thoughts into action.
